Powell Gilbert recently featured in JUVE Patent’s new weekly newsletter, PaceMaker.
Partner Alex Wilson, a neutral at the PMAC and member of the PMAC FRAND Guidelines Group, shared his views on the growing role of arbitration in resolving FRAND and SEP disputes.
As Alex noted, “The PMAC has now created a new situation. It is the first patent arbitration forum to be part of an existing court system.”
“ADR is underused,” Wilson added, commenting that PG has been offering arbitration since it was established 20 years ago and has already gained experience across a wide range of sectors, from pharmaceuticals to SEP disputes. “Resolving a global patent dispute with a single decision is certainly an attractive prospect”
With arbitration increasingly being discussed alongside traditional litigation routes, Alex also highlighted the appeal of achieving a global resolution through a single decision.
