How are European courts’ approaches to FRAND rate-setting evolving?

As decisions across Europe continue to shape royalty-setting frameworks – from the early FRAND rulings by the UPC to evolving approaches in the UK and Germany – courts are increasingly confronted with complex questions around the licensing of SEP portfolios.

At the same time, the proliferation of IoT devices, the emergence of 6G technologies, and the rapid development of AI-related innovations are creating new licensing challenges, with which the courts will need to grapple, that may further influence how FRAND royalties are assessed and determined.

Powell Gilbert partner Bethan Hopewell will be speaking on Panel II, sharing an update on rate setting inside the courtroom, from 16:00 CEST.
